Terms of Service

1. Agreement and eligibility

By creating or using an account, you agree to these Terms and our Privacy Policy. People under 18 need permission from a parent or legal guardian. Children under 13 may use WINFACTR only after we verify parental consent. WINFACTR Pro, including the free Pick Optimizer run, is available only to members 21 or older. Sponsorship buyers must be at least 18 and authorized to act for the advertiser. You must give your real age range; after sign-up, only our support team can change it.

2. Accounts and security

Provide accurate information, keep your sign-in details private and tell us promptly about suspected misuse. Display names must be unique. You are responsible for activity through your account unless you promptly notify us of unauthorized access. You can sign out of other devices at any time in Settings.

3. Predictions, picks, the Pick Optimizer and results

WINFACTR publishes probability estimates and analytical measurements, not guarantees, betting advice or promises of outcomes. Football is uncertain and estimates can be wrong.

The Pick Optimizer, its simulations, "what if" checks and weekly reviews are planning tools built on those estimates. They show no payouts, do not recommend wagers, and past results do not predict future ones. You alone decide how to use them. Do not rely on WINFACTR for financial, wagering or other high-stakes decisions.

4. WINFACTR Pro and billing

WINFACTR offers a Free plan and a paid Pro plan. Free accounts held by members 21 or older include one complete Pick Optimizer run, counted only once a portfolio is saved.

Pro and the free run are limited to members 21 or older. If we learn a member is under 21, Pro and any complimentary access end, and we refund any paid period we are told about. Giving a false age is a breach of these Terms.

Pro is billed monthly or yearly through our payment provider and renews automatically at the then-current price until you cancel. You can cancel or manage Pro at any time in Settings; access continues until the end of the paid period. Except where the law requires otherwise, we do not refund partial periods. We will give advance notice of price changes, which apply from your next renewal. We may provide Pro at no charge at our discretion and may end complimentary access at any time.

5. Groups, chat and user content

You may submit picks, messages, reports, display names and other content. You keep ownership of your content and grant WINFACTR a non-exclusive, worldwide license to host, display, process and moderate it solely to operate, secure and improve the service. Do not post threats, harassment, hate, sexual exploitation, unlawful content, spam, impersonation or another person’s confidential or intellectual property.

Automated screening may block or flag content. Members can report messages; group creators can remove messages and mute members; authorized administrators can review moderation records. We may preserve evidence, restrict access or remove content when reasonably necessary for safety, law or enforcement.

6. Acceptable use

Do not scrape or bulk-download the service, access it through automated means without permission, resell or republish our estimates, try to get around plan limits or access controls, probe for vulnerabilities, or interfere with the service or other users.

7. Sponsorships

Sponsorships are labeled and never influence predictions. Advertisers must own or have permission to use submitted names, logos, copy and links. Creative cannot promote prohibited, deceptive or unlawful products, guaranteed picks, adult services, payday lending, casino or betting offers, or malicious destinations.

A booking is a request, not a guaranteed placement. Inventory is temporarily held, then reviewed. Approved campaigns are confirmed only after hosted card payment clears. Delivery may change for schedule changes, safety, policy, technical failures or legal requirements. Refunds are evaluated case by case. Advertisers must review and accept the current Terms before submission and payment. The "Sponsor" label on an account reflects booking history and gives no additional rights.

Sponsor spots are never shown to signed-in members under 18 or to Pro members. Visitors who are not signed in may see sponsor spots, which are limited to creative that passes our family-safe rules. Advertisers accept that their spots will not reach signed-in minors and that audience and delivery numbers reflect this.

8. Third-party content

News headlines link to their original publishers. We do not control or endorse third-party content or sites, and your use of them is governed by their own terms.

9. Intellectual property

WINFACTR’s software, design, analysis, methods, branding and original editorial content are protected by law. NFL and team names and marks belong to their respective owners. WINFACTR is independent and is not endorsed by or affiliated with the NFL or its teams.

10. Suspension and termination

You may delete your account in Settings; cancel any Pro subscription first to stop future renewals. We may limit or end access for material violations, fraud, security risk, legal obligations or harm to others. Provisions that should reasonably survive—such as payment, licenses, disclaimers and liability limits—continue after termination.

11. Disclaimers and liability

The service is provided “as is” and “as available.” Features, data sources and availability may change, and outages may occur. To the fullest extent permitted by law, WINFACTR disclaims implied warranties and is not liable for indirect, incidental, special, consequential or punitive damages, lost profits or lost data. Any aggregate liability is limited to the amount you paid WINFACTR during the 12 months before the claim, or $100 if you paid nothing. Some jurisdictions do not allow every limitation, so applicable rights remain.

12. Indemnity

If you use sponsorship services or misuse the service, you agree to defend and indemnify WINFACTR from third-party claims arising from your creative, destination, products, legal violations or breach of these Terms, to the extent permitted by law.

13. Governing law and changes

WINFACTR LLC operates WINFACTR. Florida law governs these Terms, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Florida, unless applicable law requires otherwise. We may update these Terms and will request renewed acceptance when a material new version applies.
